Former Indian cricket board president Jagmohan Dalmiya Tuesday challenged the legality of the summons issued to him by its disciplinary committee.
Dalmiya told a civil court here he would not be able to attend the disciplinary committee meeting Wednesday due to the Cricket Association of Bengal (CAB) elections. The independent observer appointed for the polls would scrutinise the nomination papers Wednesday.
Dalmiya pleaded that the board be ordered not to give effect to his suspension from attending its meetings as CAB president.
The board had issued summons to Dalmiya following his alleged failure to reply to a show cause notice asking him to furnish details of bank transfer of Rs.400 million to an account of the CAB from the board.
Since Dalmiya did not reply to this notice, the BCCI debited the amount to CAB, of which he is the president.
Dalmiya, however, said he did not have sufficient documents to defend the charges of financial irregularities hurled against him.
BCCI president Sharad Pawar heads the disciplinary committee.
The BCCI had also alleged misappropriation of the 1996 World Cup funds by Dalmiya and lodged police complaint against him in Mumbai.
